STAB VIDA provides the Stabvida birds mobile application (“App”) that will be used by the users to perform bird sexing requests, order kits, and buy pre-paid packs.

STAB VIDA respects your right to privacy in the online domain, when you use our App, and communicate electronically with us. In this way, we developed this Privacy Policy to inform you how and why STAB VIDA process the personal data that you provide us through the App operated by STAB VIDA. By using this App, you are accepting the practices described in this privacy policy. If you do not agree to this privacy policy, please do not use this App. We reserve the right to make changes to this privacy policy at any time. Any changes will be posted in this privacy policy and material changes will generally apply to activities and data collected in the future. We encourage you to check this privacy policy regularly to ensure that you are aware of any changes and how your data may be processed. What is covered by this Privacy Policy?

This Privacy Policy applies exclusively to the processing of data, including personal data on the App.

What is personal data?

According to the REGULATION (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data:
"personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Who is responsible for data processing?

The entity responsible for the processing of personal data is STAB VIDA and, in that context, decides which data is collected, the means of processing the data and for what purposes are used.

What kind of personal data do we process and why?

Our App may need access to certain features, such as Internet, Camera and User personal data, in order to properly function. After installation and while running the App, it will request the User for permission to access the required features and/or information. The User may deny the permissions but the App functionalities may become limited or even not possible to use. The processing of personal data is based on the User’s explicit consent and on the necessity for the performance of a contract, in accordance with Article 6(1)(a) and (b) of the General Data Protection Regulation (GDPR). The features required for the App to run on your mobile phone and perform bird sexing requests, order kits, and buy pre-paid packs are described below:

Internet

This permission is required to login into the App and to register the bird sexing requests, the ordered kits and the bought pre-paid packs in the STAB VIDA server. The User may opt-out on this permission, however it will not be possible to use the App.

Camera

This permission is requested to allow the application to access the camera, enabling the User to scan the barcode included with the STAB VIDA kits, take photos of birds to attach to sexing requests, and capture proof of payment. Granting this permission is optional. However, if declined, the User may enter the kit barcode manually. In addition, to upload proof of payment or to add photos of birds to sexing requests, the User must allow access to the device's gallery.

Storage of Personal Data

This permission is requested to allow the storage of data used to identify the User when accessing the App. This identification enables the display of the User's profile information on the results certificate, the delivery of ordered kits, and the issuance of invoices with the User’s VAT number. Providing a VAT number is optional; if not provided, invoices will be issued without it. The remaining information is mandatory. This permission is required for the App to function properly. If the User does not grant this permission, the App cannot be used.

Storage of Image

These permissions are requested to allow the use of images for adding bird photos to sexing requests and for uploading proofs of payment. Granting this permission is optional. However, if the User declines, they will still need to take photos of the proofs of payment, and any bird images included in the requests must also be captured using the camera.

Notifications

This application sends notifications solely related to the status of your orders and purchases, such as changes in the status of your bird sexing requests, kits being sent, and confirmation of prepaid packages. You can enable or disable each of these notifications individually within the app settings. No promotional or marketing communications are sent through this application.

Payments

The application uses the PayPal service to process payments. During this process, we share limited information with PayPal, such as the transaction amount and a description of the purchased product or service. PayPal may also collect additional technical data, including device identifiers, IP address, and usage information, in accordance with its own privacy policy. When and how do we collect and process your personal data?

STAB VIDA collects your data through the App, with your consent. In a regular basis, personal data is collected when you install the App, upon registration. Some personal data are mandatory and, in case of lack or insufficiency of these data, STAB VIDA cannot accept your registration. In each case, STAB VIDA will inform the Users of the mandatory nature of the provision of personal data in question in which case the rules of this Privacy Policy will apply. The personal data collected are treated and transmitted in strict compliance with the legislation on the protection of personal data, and are stored in a specific database and in no case will the data collected be used for another purpose other than that for which the consent of the data subject was given.

What are the purposes of processing personal data?

In the App, the personal data collected and processed is intended to provide Users with exclusive access to submit bird sexing requests, ensure the delivery of ordered kits, and issue invoices that include the User's VAT number.

How we handle data storage?

We receive data input into the App before it is then stored in cloud servers, which are located in France. We have implemented appropriate security measures and controls to protect personal information, such as using modern cryptography (HTTPS) to transmit the collected personal data.

How long do we keep your personal data?

The length of time during which the data is stored and preserved varies according to the purpose for which the information is processed. Effectively there are legal requirements that require data retention for a minimum period of time. We do regular backups of these data to our server and we also recommend you to make backups of your data in a regular basis. You can also decide to delete your account at any time and all data associated with your account will be anonymized. However, be aware that this process is irreversible.

How can you access, rectify or oppose the processing of your personal data?

Under the terms of the Law of Protection of Personal Data, is guaranteed to the data subject the right to access, update, rectify or delete his or her personal data at any time. In the App, you can delete your account at any time and all data associated with your account will be anonymized. What measures have been taken by STAB VIDA to ensure the security of your personal data?

STAB VIDA is committed to ensure the protection and the security of the personal data that are made available to us, and has adopted and implemented rules in this regard. Compliance with these rules is an undeniable obligation to all of those that legally access them. Notwithstanding the security measures adopted by STAB VIDA, we are obliged to alert all App users that they should take additional security measures, namely to ensure that they use an updated android phone, PC and/or Browser in terms of properly configured security patches, with active firewall, antivirus and antispyware, and make sure about the authenticity of the mobile apps you install and websites you visit on the internet, and avoid websites whose reputation you do not trust.

Automated Decision-Making and Profiling

We do not use your personal data to make automated decisions or to carry out profiling that produces legal effects concerning you or significantly affects you.

How do we use Cookies?

"Cookies" are small software labels that are stored on your computer through the browser, retaining only information related to your preferences, not including your personal data. STABVIDA may use cookies to help determine the usefulness, the interest and the number of uses of its websites, allowing a faster navigation, eliminating the need to repeatedly enter the same information. The use of cookies is a normal practice among Internet websites, and most Internet browsers allow a user to accept, decline or delete cookies, in particular by selecting the appropriate settings in their browser. The App does not use cookies, however in case of future use, the cookies policy will be applied. Be aware that through your browser you can disable cookies for any website you visit.

Right to Lodge a Complaint

If you believe that your personal data is not being processed in accordance with the General Data Protection Regulation (GDPR), you have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, place of work, or place of the alleged infringement. In Portugal, the supervisory authority is the Comissão Nacional de Proteção de Dados (CNPD).

How can you become aware of any changes to STAB VIDA's privacy policy?

STAB VIDA reserves the right at any time to make adjustments or changes to this Privacy Policy, these changes being duly publicized on the App and STAB VIDA website.
